Simple way to reduce some of the load on the servers

Move the update check

Move the update check to when someone clicks on the multiplayer tab, instead of when they first load up the game.  If there is anything copyright protection related in there it is moot since the pirates got around it.  This will help reduce load on the servers, why have the server pinged every time the game starts if someone is only playing singleplayer?

Make sure to include some sort of check, to ensure that it only checks for an update the first time you click on multiplayer per game session, or you defeat the point of moving the check.

That is a VERY good idea.  This was actually exactly how they solved a problem on a certain PS3 game I got.  They too were having their servers crash like crazy due to anyone even playing single player hiting all the servers all the time at once.  I think it was Little Big Planet. For a long time you had to disconnect your internet connection to even play the game.   Oh ya it was GTAIV. They fixed it so that every player didnt ping the server like you said when just playing single player and that cut down their load DRASTICLY, and fixed the whole deal.  I think there's still posts about it around.

I think its kinda obvious though and they figured this out already.  But ya never know.  They still havent figured out the standard rez for 720p HiDef TV/Monitors.  Which is 1280x720. Everyone else has.

Sadly, that won't reduce the problem with 100 000 warez copies that aren't updated trying to connect on Stardock servers ....

To get around that, patch all clients to point to a different address for the servers.  Take down the old address.  Now all the warez copies are pinging a nonexistent address.

But you still want to fix the issue so it only connects when they try to log on, otherwise if a patched copy gets leaked out, it'll just be the same problem all over again.

Saddly, until registration is made and game patched, there is no way to differentiate a warez copy from a legit retail one.
