I have to agree with you, we should not intrude on states rights. However, this act will not become/stay a law for two reasons 1) the bill will not get approved by the senate or the house. Not to mention, President Bush will veto it 2) if it is unconstitutional, as you have said, then the Supreme Court will deem it unconstitutional and it will cease to exist.
